Terms of Service

1. Agreement

By accessing or using Like Magic ("the Service"), operated at trylikemagic.xyz ("we," "us," "our"), you ("you," "the User") agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Like Magic is a creative partner platform that helps you build apps, websites, and digital experiences through conversational AI. You describe what you want, and the Service generates functional outputs on your behalf.

3. Your Account

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content & Intellectual Property

• You own your inputs. All content, data, brand assets, and proprietary information you submit ("Your Content") remains your property.
• You own your outputs. Apps, websites, code, and other materials generated by the Service based on Your Content are yours to use, modify, and distribute.
• Limited license to us. You grant us a limited, non-exclusive license to process Your Content solely for the purpose of delivering the Service. This license terminates when you delete your account or request data removal.
• Confidentiality. We treat Your Content as confidential and will not share, publish, or disclose it to other users or third parties, except as required to deliver the Service (e.g., sending prompts to AI providers) or as required by law.

5. Acceptable Use

You agree not to use Like Magic to:

• Build anything illegal, fraudulent, or harmful
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, exploit, or abuse the platform
• Submit content that is unlawful, abusive, or violates the rights of others
• Resell or redistribute access to the Service without written permission
• Use the Service for spam, phishing, or other deceptive practices

6. AI-Generated Content

• Outputs are generated by artificial intelligence and may contain errors, bugs, inaccuracies, or security vulnerabilities.
• You are solely responsible for reviewing, testing, and validating all generated content before deploying it, using it in production, or sharing it with end users.
• We do not guarantee that generated outputs are free of intellectual property conflicts. You are responsible for ensuring your use of outputs complies with all applicable laws and regulations.
• AI-generated code should be treated as a starting point, not a finished product. Professional review is recommended before production use.

7. Service Availability

We strive to keep Like Magic available and reliable, but we do not guarantee uninterrupted or error-free service. We may update, modify, or discontinue features at any time. For hosted projects, we will provide reasonable notice before changes that affect availability.

8. Payments

Paid features are billed as described at the time of purchase. Payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's terms of service. Refund requests are handled on a case-by-case basis.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that outputs will be accurate, reliable, or suitable for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.
• We shall not be liable for any damages arising from your reliance on AI-generated outputs, including code errors, security vulnerabilities, data loss, or business decisions made based on generated content.
• We shall not be liable for any damages resulting from unauthorized access to or alteration of your data, or from the conduct of any third party on the Service.
• Our total aggregate liability for all claims arising from or relating to the Service shall not exceed the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Like Magic and its affiliates, officers, agents, contractors, and employees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights, including intellectual property rights
• Any content you submit to or generate through the Service
• Your deployment or distribution of outputs generated by the Service

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Like Magic regarding your use of the Service.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of Like Magic after changes constitutes acceptance. We will notify you of material changes by posting the updated Terms with a new "Last updated" date.
